MASYEN ENGINEERING INC. LIGHTING TEXT UNDER THE LAW ON THE PROTECTION OF PERSONAL DATA NUMBER 6698

This "Clarification Text" has been prepared by MASYEN MÜHENDİSLİK INC. (“MASYEN”) in the capacity of data controller in accordance with the Law on Protection of Personal Data No. 6698 (“PDPL”). Its purpose is to inform you about the collection methods, processing, use, transfer and destruction of your personal data within the framework of Article 10 of the PDPL titled 'Informing Obligation of the Data Controller' and Article 11 of the titled PDPL 'Rights of the Relevant Person'.

Purposes of Processing Personal Data

Your personal data, verbally, in writing or electronically, within the framework of Articles 4, 5 and 6 of the PDPL;

• To be able to carry out our Human Resources processes and activities within the determined legal framework,
• Planning, auditing and execution of information security processes,
• Creation and management of information technology infrastructure,
• Follow-up of finance and/or accounting works,
• Contract management, establishment of legal transactions and follow-up of legal processes,
• Ensuring facility and personnel security,
• Ability of company personnel to benefit from preventive and curative health services,
• Performing efficiency and/or appropriateness analyzes of our commercial activities, planning and/or execution of these activities,
• Determination and implementation of commercial and business strategies
• The ability of MASYEN ENGINEERING INC. to fully and duly fulfill its contractual and legal obligations,
• It will be processed for the purposes of evaluating and responding to the suggestions, requests, complaints and malfunction notifications you send to us through our website and to carry out improvement studies in accordance with the notifications.

 

Scope of Personal Data

MASYEN ENGINEERING INC. (in the capacity of Data Controller), especially the Turkish Commercial Code No. 6102, PDPL, Labor Law No. 4857, Code of Obligations No. 6098, Turkish Penal Code No. 5237, Law No. 5651 on the 'Regulation of Broadcasting on the Internet and Fighting Against Crimes Committed Through These Broadcasts' and other relevant legislation and regulations, act within the framework of legal obligations.

Personal data (name-surname, address, profession, education, marital status, date and place of birth, CV, e-mail, telephone number, gender, license plate, location data opened when entering the website and IP address) will be processed in accordance our company will be able to obtain, save, preserve, update, rearrange personal data in order to continue its services, transfer it to third parties in the country or abroad in cases and to the extent permitted by the legislation, and process it by taking the necessary administrative and technical measures in other ways approved by the laws.

Personal data may be processed based on your explicit consent or because it is expressly required by law, is necessary for the establishment or performance of the contract, is necessary for the fulfillment of a legal obligation, or if it is required by legitimate interests. MASYEN ENGINEERING INC. will be able to process personal data by taking all necessary information security measures, provided that it is not used outside of the purposes and scope specified in the Personal Data Protection Clarification Text. Personal data will be kept during the legal storage period or as required by the purpose of processing, and will continue to be used by our Company after being anonymized at the end of the period required by the processing purpose, or will be destroyed in accordance with the Company Procedures in accordance with the Personal Data Protection Law and relevant legislation.

Provided that adequate measures are taken within the framework of the security and confidentiality principles specified in the PDPL, our direct/indirect/domestic/foreign affiliates, legal and real persons with whom we have contracted due to our activities, suppliers, subcontractors, business partners, shareholders, legal, financial and tax consultants, auditors, audit companies or public institutions or organizations that are authorized to request this data as required by a legal obligation, and other relevant persons or institutions within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the PDPL.

 

Your Rights Under the Personal Data Protection Law

As personal data owners within the framework of Article 11 of the PDPL, without prejudice to the cases stipulated in Article 28 of the PDPL titled "Exceptions";

a- Learning whether your personal data is processed or not,

b- If your personal data has been processed, requesting information about it,

c- Learning the purpose of processing your personal data and whether it is used in accordance with its purpose,

d- Knowing the third parties to whom your personal data is transferred in the country or abroad,

e- Requesting correction of your personal data if it is incomplete or incorrectly processed,

f- To request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the PDPL,

g- Requesting notification of the transactions made in accordance with subparagraphs (e) and (f) above, to the third parties to whom your personal data is transferred,

h- Objecting to the emergence of a result against you due to the analysis of your personal data exclusively by automated systems,

ı- You have the right to demand the compensation of the damage if you suffer damage due to the unlawful processing of your personal data.

 

It is important for you to exercise your rights that the information/data you share with MASYEN ENGINEERING INC. is correct and transferred to MASYEN ENGINEERING INC. correctly. Responsibility arising from giving wrong or erroneous information belongs to the party who transmits the information/data to MASYEN ENGINEERING INC.
